In the wake of Hamas’ attack on Israel on October 7, 2023, indictments have been filed in 18 cases of approval of a terrorist act.
Three people have so far been sentenced to unconditional imprisonment, three have received a suspended sentence, and three have been acquitted.
Suspended sentences:
A 29-year-old woman was sentenced to 40 days in prison on December 20 in the Court in Esbjerg for writing “Best news to wake up to” followed by five emojis in the shape of the Palestinian flag. This happened in a comment on a post on Ekstra Bladet’s Facebook page with the headline “Live: Israel attacked with missiles”.
A 16-year-old girl was sentenced to 30 days of suspended prison in the Court of Aalborg on October 29 for writing “Yass” in a comment on the same post on Ekstra Bladet’s Facebook page. “Yass” was followed by a smiley with heart eyes and an emoji with the Palestinian flag. The verdict has been appealed.
A 19-year-old woman participated in a demonstration at Christiansborg Palace, where she was asked on TV if she was angry that Hamas had committed terrorist attacks. “I’m super happy that Hamas made that decision,” was the answer. The woman was sentenced to five months’ suspended prison in Copenhagen City Court.
Sentenced unconditionally:
A 30-year-old man was sentenced to nine months in prison in Copenhagen City Court in August for saying, among other things, at a demonstration and on Hizb ut-Tahrir’s YouTube channel: “Remember what you have seen” and “Let it be an eternal memory.” The sentence has been appealed.
An influencer’s Snapchat video, in which he celebrated the attack with music and dancing, was sentenced to four months in prison by the Copenhagen City Court. On July 1, the High Court changed the sentence to six months in prison.
A 60-year-old man’s statement to BT that it was a “super attack” has also resulted in an unconditional prison sentence of five months at the Copenhagen City Court.
Acquitted:
A 28-year-old woman wrote on Politiken’s Facebook page: “There has been war for 73 years but only NOW is Hamas really fighting back. With good reason!”. She was responding to an article about 7,000 dead children in Gaza. The woman was acquitted by the Court in Odense. She had not intended to violate the provision. The prosecution has appealed the case.
A 33-year-old imam participated in a debate program on 24syv. The imam spoke, among other things, about reactions to the Hamas attack on Israel, and the 30-year-old said that he did not think it was something to be cheered about, but he “saw it as a necessary evil”. The Copenhagen City Court did not believe that it had the character of explicit approval.
A 28-year-old woman wrote in a comment in a Facebook group “Hamas (followed by four hearts) They are the only ones fucking doing anything.” The court in Hjørring found it not proven that the words were linked to the terrorist attack
