A Syrian man convicted for membership in a terrorist organization is given a new chance at Austrian citizenship following a decision by the Constitutional Court (VfGH)
A Syrian national who has been definitively convicted of belonging to a terrorist organisation could be granted a second chance to obtain Austrian citizenship following a ruling by the Verfassungsgerichtshof (the Austrian Constitutional Court).
He has been living in Austria with refugee status since 2014 and was sentenced by the Graz Criminal Court in November 2016 to 30 months’ imprisonment for belonging to the group ‘Liwa al-Tawhid Idlib’. The Graz Court of Appeal confirmed this sentence on 9 August 2017, reducing the term of imprisonment to two years.
According to the case file, the alleged offences relate to the period 2012–2013 in Syria, during which time the man is said to have joined the Liwa al-Tawhid Idlib group. He is also said to have received military training, participated in propaganda activities, and taken part in the organisation’s military operations.
